Ladies and Gentlemen, 

We are asking for help with an important case involving a Polish citizen who, as a result of unfavourable circumstances, has been  falsely accused of treason in the Papuan jungle part of the island belonging to Indonesia . Our friend, Jakub 
Skrzypski, aka Jakob or nicknamed Kuba,  is currently awaiting  a political trial.

On August 26 of this year, Kuba was arrested in the mountain village of Wamena, West Papua, and taken to prison in Jayapura the next day. Kuba - an experienced tourist, who has done about ten visits in different parts of Indonesia - has been charged with crimes under articles 106, 110 and 111 of the Indonesian Penal Code. The articles constitute a particular legal construction, used as a tool to create false accusations, particularly in the region where Kuba Skrzypski was staying. Almost anything can be addressed in this article, which constitutes an accusation of an "act of treason" against the Indonesian State.

The intentions of the Indonesian authorities have been visible from the beginning. Everything was used against Kuba to create a "legal" construction that, in the eyes of the public, criminalized him. As "proof" against him, the Indonesian media showed his private photos of Switzerland (where  Kuba  lives) and even the Swiss souvenirs he carried, including the flag of the canton of Vaud! The French words on this flag, proudly proclaiming "Freedom and Homeland" refers to a specific region or canton (small state) of Switzerland, but the Indonesian law enforcement agencies recognized it as "evidence" of Papuan incitement against the Indonesian government!

Kuba's detention centre is in the Indonesian jungle. Already in detention for more than two months, this is a difficult experience. In overcrowded cells, there is a division between those who have the luxury of sleeping on a dirty mattress and those who have to settle for a place on the concrete floor, there is a lot of dirt and chaos. Even allocations of drinking water have been drastically cut off. Kuba, awaiting the trial date, is deprived of many basic facilities so necessary in daily life.

On 2 November,  Kuba  was flown to Wamena, another place of detention. The Indonesian authorities - for undisclosed reasons - have chosen this mountain village as the arena for a political trial. It should be noted that over the past two months, the Indonesian authorities have not been able to decide what they were accusing Kuba of. When the absurd allegations of "arms trade" and "supporting the separatists" fell (it should be pointed out here that  Kuba   in Switzerland works as a laborer and spends his available money on travel and living expenses; he has no savings, does not own property or a car, etc.), only the "Act of Treason" accusation was maintained, and this heading can cover anything...

Therefore, from the day of the detention, as an informal support group, we launched an aid campaign in favour of Kuba. Legal assistance is the most important at the moment. We were able to obtain as counsel, P. Latifah Anum Siregar, an excellent and experienced lawyer, who protected others against similar charges, including foreign citizens.



And that's where your help is needed. Due to the malicious actions of the Indonesian authorities (including the transfer of the process to the mountains and jungle of Vamena or Wamena, located in the mountains and jungle, accessible only by air), treatment costs have increased. Latifah Anum Siregar estimated the costs - which are not his fees, but only the objective costs of flights, accommodation, etc. for the entire legal team - at USD 18,000. Calculated in zlotys, this represents about 68,000 zlotys. We managed to collect PLN 8,000 ourselves. We therefore ask you to help us recover the remaining PLN 60 000.



Let's help Kuba! Let us not leave the Indonesian authorities who senselessly want to sentence him to a few years in prison! Left to his own devices, without adequate legal protection, he will not be able to get out of this Asian hell. Every week and every month spent in this detention centre is an excruciating experience, not to mention the years spent in the Indonesian prison! Especially if you are the victim of false accusations.

JOINT STATEMENT: CALL FOR IMMEDIATE RELEASE OF SIMON MAGAL AND JAKUB SKRZYPSKI - The West Papuan and Polish pair have been charged with treason

TAPOL and the East Timor and Indonesia Action Network (ETAN) call for immediate release of Simon Carlos Magal and Jakub Fabian Skrzypski. In the event that Mr. Skrzypski is prosecuted, we call on all representative parties to ensure that he is afforded a fair trial.
Indonesian police arrested West Papuan student Simon Carlos Magal, 29, on 1 September 2018 in Timika, in connection with the arrest of Jakub Fabian Skrzypski several days earlier.[1]  According to news reports, Mr. Skrzypski, a Polish citizen, was visiting West Papua as a tourist when he was detained by police in Wamena. He was arrested on suspicion of being a journalist, and for reportedly meeting with alleged members of an armed independence group in West Papua.[2] The two men have been charged with treason and are currently in jail awaiting trial in Jayapura.
The opinions and facts included below are based on information collected from media reports, human rights defenders on the ground, and families and friends of those affected. We understand the complications of the subject matter at hand. We also recognise the sensitivity of the issues and the Indonesian police’s role in investigating any activities not in accordance with the law, particularly relating to the dealing and possession of arms. The following findings have not yet been published in any media. Our aim is to shine more light on this case and to encourage Indonesian law enforcement agencies and the general public to maintain the presumption of innocence towards both Mr. Magal and Mr. Skrzypski.
Before his arrest, Mr. Magal was preparing to depart for post-graduate studies in Australia. A well-respected West Papuan lecturer, MY, has publicly condemned the arrest and expressed his frustration. Mr. Magal planned to join MY as a lecturer at the most prominent state university in West Papua once Mr. Magal finishes his studies. Mr. Magal’s contacts with Mr. Skrzypski were limited and Mr. Magal has no capacity to carry out the weapons negotiations that he is being accused.
Charging Mr. Magal with treason for having met Mr. Skrzypski and communicated with him on Facebook is excessive and not commensurate with Mr. Magal’s actions. We believe that Mr. Magal has simply been dragged in by the actions of Mr. Skrzypski. Our findings show that Mr. Skrzypski is merely a tourist who may have been acting recklessly and irresponsibly in a conflict area. As a result, local people like Mr. Magal are left to face superfluous consequences.
Close friends of Mr. Skrzypski that we interviewed describe him as an avid ‘extreme’ traveller with a passion for other cultures, languages, and humanitarian issues. He had previously travelled to Armenia, Myanmar, and Iraq to learn about their cultures and respective histories of genocide. Before finally visiting West Papua, he had travelled multiple times to many places in Indonesia. He can speak Indonesian and, to a lesser degree, some local languages including Javanese, Ambonese, and Sumbanese.
Sources indicate that Indonesian police used Mr. Skrzypski’s photos of him holding guns as evidence of him being an arms dealer. A clarification that we received from one of Mr. Skrzypski’s travelmates, alias AS, is that some of the photos was taken at an indoor sport shooting range located in Vaud, Switzerland, where Mr. Skrzypski had been living since 2008. Police confiscated all of Mr. Skrzypski’s belongings, including the Liberté et Patrie, Vaud’s cantonal flag.
As an ‘extreme’ traveller, the West Papua Liberation Army is not the first armed independence group that he has met for the sake of adventure. He had also visited the Kurdish Liberation Army in the troubled Qandil mountains region in Iraq in Spring 2017, before the liberation of Mosul from ISIS. His intention to learn about West Papua’s struggle is indeed easily misinterpreted by the Indonesian government. While Mr. Skrzypski’s choices may have been irresponsible and regrettable, his circumstances appear those of an idealistic and naive traveller, and not one of a criminal. By being accused of multiple counts of treason, we feel he has been unfairly charged.
According to people that Mr. Skrzypski met in West Papua, he told them that he wished to learn about West Papuan culture, language, and their struggle for self-determination. He did document his travel and meetings, as many tourists do, which ought not to be confused with “journalistic activities.”
Reports indicate that Indonesian police were concerned about videos obtained from Mr. Skrzypski’s phone. Some videos allegedly depict several West Papuans thanking the Republic of Poland for Mr. Skrzypski’s visit. We feel this should not cause an over-reaction. Expressions of thanks to an individual’s State, instead of towards the individuals themselves, is a way West Papuans commonly express thanks for international solidarity.
Two other West Papuans, EW and AW, were arrested for possession of ammunition at a similar time and location as Mr. Skrzypski’s arrest. A prominent local human rights defender, GK, who had met EW, AW, and Mr. Skrzypski, found that the ammunition belonged to EW and AW and not Mr. Skrzypski. He believes that the two separate cases have been confused.
Convictions for treason charges can carry maximum sentence of life imprisonment or 20 years in Indonesia. The charge has long been used in West Papua to intimidate those who oppose or question Indonesian rule there, and to criminalise rights to freedom of expression. These latest charges against Mr. Magal and Mr. Skrzypski jeopardize the Indonesian government’s efforts to strengthen national democracy, and reverses a trend which showed fewer cases tried for treason over the past few years.
Recommendations
We call for:
  • The immediate release of Simon Carlos Magal
  • The immediate release of Jakub Fabian Skrzypski

We believe that Mr. Skrzypski has been unfairly charged. In the event he is prosecuted, we call on all representative parties to:
  • ensure that Mr. Skrzypski is afforded a fair trial.

We call on the Indonesian government to:
  • stop using highly problematic treason charges that have long been used in excess to both intimidate peaceful dissent and to criminalise rights to the freedom of expression.

Hi Stephen,
I thank you so much to give us information about Jakub. Yes we took contact with the Polish Embassy in Switzerland and in Jakarta and the Indonesian Embassy in Switzerland. The Polish Embassy in Jakarta answered us that they give only information to his family, who’s informed about Jakub’s detention in Indonesia in the meantime.
I know Jakub less than one year. I had the opportunity to meet him during the meetings for the initiative of the sovereign money here in Switzerland in the city of Lausanne. I took the advantage during this period to speak about the NGO WBBC Wind of Bethlehem Breath of Charity, I wanted to create and register with a couple of people in Bulgaria. Its Headquarter is here in Switzerland. Jakub travelled with me to Bulgaria to become a member of the association registered in Bulgaria.
Yes Jakub is a person who loves to travel and to act for good causes. But as I know him he’s an active pacific supporter… I can’t imagine that Jakub would have used guns. If they are some photos from Jakub with guns, I don’t know the context about.
Could you have a possibility to take contact with Jakub’s family? We don’t have the contacts from his family? Maybe the family could give more information about the photos and the context?
Romuald Djomo has experience with the Embassy’s and has a badge at the United Nations Organization for human rights. He’s a volunteer of the NGO VBBC here in Switzerland.

Series of arrests in Papuan central highlands – Police takes Polish citizen into custody





Human rights defenders in the Jayawijaya Regency have reported a series of arrests between 25 and 26 August 2018. According to the received informantion, members of the Jayawijaya District Police arrested eight people, one of them a Polish citizen named Jakub Fabian Skrzypski (39). Mr Skrzypski and three Papuan men were arrested on 25 August 2018 around 12.20 pm at the Napua Military Post in Wamena. Subsequently, they were interrogated at the Jayawijaya District Police Station and later released at 02.00 pm.

On 26 August 2018 at 09.10 am, police officers again arrested Naftali Wasahe and Edward Wandik together with two Papuan senior high school students at the Potikelek Market in Wamena. Jakub Fabian Skrzypski was arrested in his Hotel in Wamena. On the same day, members of the Jayawijaya District Police conducted two further arrests in the nearby city of Elelim, in the Yalimo Regency. Alex Wasahe and Yohanis Wandik were arrested at 08.20 pm and brought to the Jayawijaya district police station in Wamena for further interrogation. According to local informants, the police had allegedly found amunition in possesion of some of the arrestees.

On 27 August at 10.00 am, police officers transferred Jakub Fabian Skrzypski to Jayapura. The Association of Human Rights Lawyers for Papua (PAHAM Papua) stated he is being held in an inadequately ventilated cell, given poor food and hasn’t been able to contact family or change his clothes. The police suspects that Mr. Skrzypski is a journalist who had established contact with members of the armed resistance in Wamena. Indonesian authorities stated that he may be charged for the violation of immigration law because he entered Indonesia with a tourist visa instead of a journalist visa. Gustaf Kawer - a Papuan human rights lawyer who visited Jakub Skrzypski in his detention cell in Jayapura - stated that Mr Skrzypski was visiting Papua as a tourist.

      My awesome journey to Swiss first stated with Jakob, very friendly person, he has enormous knowledge.
      What really impressed me is his interest in reading and knowledge seeking.

          Jacob is a wonderful man. We spent a very nice time with my girlfriend at his place. Jakob accepted us royal, take us on a little trip to the area, share with us local food, talked about everything we needed to see in Switzerland. He has really great knowledge about the area and the world in general. And has a huge collection of music, the biggest I have ever seen. Very positive and helpful person. He helped us plan a further route and although he had to go to work he left us his keys so we could still explore the area before further travel. It was a really great experience. Thanks again Jakob! Meet the dreams and good luck! I hope we will meet again! :D

                              It was soooo nice! I was traveling with a friend and my big dog (Asha) and we ask in the morning for the night in the same day, so he answered us so fast and he gave to us a lot of hospitality. It was a pity that we were arrive in his home late and we didn't have a lot of time to spend with him (just 2 hours walking in the lake). He help us to find the best places, avoid the most tourists places and to make better our trip in Switzerland! Thank you so much! Jakób you are welcome in Barcelona! :)

                                  Jayapura, Jubi – Relevant documents of 30-year-old-Polish Jakup Febian Skrzypski (JFS) who arrested by a joint team from Papua Regional Police and Jayawijaya Regional Police at a hotel in Wamena City, Jayawijaya Regency, a few months ago due to an allegation associated with an insurgent group are already complete.


                                  Public Relations Chief of Papua Police Senior Commissionaire A.M. Kamal said the prosecutor office confirmed the completion of these relevant documents. Therefore, the investigators from the Directorate of Crime of Papua Police will handover both the suspect and pieces of evidence to Wamena District Attorney for further process.


                                  “Regarding this case, the investigators from the Directorate of Crime of Papua Police have questioned four witnesses,” said Kamal on Friday (10/19/2018).


                                  Skrzypski is charging against Article 106 of the Criminal Code concerning State’s treason that makes him possible to take life imprisonment or twenty years in jail. “While other suspects YS and SM are still being investigated,” he said.


                                  Earlier last month, the Head of Papua Representative Office of Human Rights Commission Frits Ramandey confirmed that the suspect Skrzypski was physically in good condition in the prison of Papua Regional Police.


                                  “Even though he is fine physically, and as a prisoner, he has his right, but I think he is psychologically stressed,” Ramandey said at the time. (*)

                                  Polish traveller blunders into Papua conflict

                                  To the Indonesian government, the 39-year-old factory worker and globe-trotting Polish traveller is a danger to the state, a man who plotted with shadowy gunmen to foment revolt in isolated eastern jungles.
                                  But to his supporters, Jakub Skrzypski is just an idealistic tourist with no money to his name, a man with an oddball combination of sympathies for right-wing and liberation causes. Even Indonesian police say it's unlikely Skrzypski could have arranged the arms deal they say he promised to make with rebels.
                                  But Skrzypski, who is charged with treason, still faces up to 20 years in prison if he's found guilty. His detention was extended by 40 days on September 17 as police prepare their case against him.
                                  He was arrested in Wamena in Papua province in late August along with four Papuans who police said had ammunition and described as linked to "armed criminal groups" - the authorities' usual description of Papuan independence fighters.

                                  "The true jungle is in Papua, and I've been there, among lizards, mosquitoes, leeches" and other stuff, Skrzypski wrote on Facebook while on the second of back-to-back trips to the region in July and August.
                                  The case highlights Indonesia's extreme sensitivity about the low-level but long-running insurgency in the Papua region, which occupies the western half of the island of New Guinea.
                                  Though most nations recognise Indonesia's sovereignty over the territory, the Papuan independence movement has vocal sympathisers in numerous Pacific island and Western countries.

Police and military personnel are frequently attacked and killed by rebels, while Indonesian security forces have been accused of dozens of unlawful killings in the past decade, including targeted slayings of political activists.
                                  Police say Skrzypski had been in contact for a "long time" with Papuan independence supporters and separatist fighters. They say he planned to publicise their cause on social media and promised to help supply them with weapons.
                                  "We have strong evidence that he was guilty in helping the armed criminal group in Papua," said the province's police chief, Martuani Sormin.

                                  "No one should disturb the integrity of the Unitary Republic of Indonesia, whether he is a foreigner or local. Anyone who violates the law in this country must be dealt with."
                                  But evidence of an actual plot against the Indonesian state appears flimsy.
                                  Photos police cited of Skrzypski with guns were taken at a recreational shooting range in Switzerland, where he has lived since 2008, said his Indonesian lawyer, Latifah Anum Siregar, and a Polish friend, Artur Sobiela.
                                  Siregar said Skrzypski denies any wrongdoing. The case against him is "very weak," she said.

                                  Civil society organizations have also protested his arrest and the arrest several days later of a 29-year-old Papuan student, Simon Magal, who met Skrzypski and communicated with him on Facebook.
                                  "While Mr. Skrzypski's choices may have been irresponsible and regrettable, his circumstances appear those of an idealistic and naive traveller and not one of a criminal," the East Timor and Indonesia Action Network and London-based rights group Tapol said in a joint statement.
                                  They said Magal's arrest was excessive and he'd "simply been dragged in by the actions of Mr Skrzypski."

                                  National police spokesman Dedi Prasetyo said Skrzypski had unfettered access to an "armed criminal group" in Papua that had designated a liaison to meet and escort him on his trips to the region.
                                  Skrzypski encouraged the group to fight against the Indonesian government and also promised weapons, but even Prasetyo acknowledged it was "very unlikely" he could do that.
                                  "We consider this case to be quite serious because it involves a foreign national," he said.
                                  Skrzypski's Facebook page indicates he supports right-wing European nationalist movements and is also interested in ethnic groups that have faced state persecution or genocide, including Armenians and Kurds.

                                  Artur Sobiela, a friend from Skrzypski's hometown of Olsztyn in Poland's northeast, said Skrzypski had traveled to Indonesia numerous times and has many friends there but "isn't on any side of Indonesian-Papua conflict."
                                  He said it was "nonsense" that Skrzypski was plotting to undermine the Indonesian state.
                                  "He hasn't any money for supporting any political groups in any region in the world," said Sobiela, who has known Skrzypski for nearly two decades.
